Fragen und Antworten zur EEG-Novelle

In unseren Webinaren, aber auch bei der Begegnung mit Installateuren tauchen derzeit eine Reihe von Fragen auf, die sich rund um die aktuelle EEG-Novelle drehen. Wir haben einmal versucht, einige davon zu beantworten – subjektiv, nach bestem Wissen und Gewissen und dem aktuellen Stand unserer Informationslage als Nicht-Juristen. Wir möchten Sie ausdrücklich dazu auffordern, vor einer Projektentscheidung tatsächlich die Verabschiedung des neuen EEG abzuwarten, um hier eine möglichst hohe Sicherheit zu erreichen. Derzeit ist das EG 2023 im parlamentarischen Verfahren, es ist daher schon noch mit kommenden Änderungen zu rechnen.
Kommt das neue EEG zum 1. Juli?
Nein. Heute ist der 24. Juni und es muss noch die 2. und 3. Lesung im Deutschen Bundestag stattfinden, der Bundesrat muss zustimmen, der Bundespräsident unterschreiben und schlussendlich das Gesetz im Bundesgesetzblatt veröffentlicht werden. Da das EEG in dieser Woche nicht mehr in den Tagesordnungen der Bundestagssitzungen steht, ist das bis 1. Juli nicht mehr zu schaffen.
Wann kommt es dann?
Die nächste Sitzungswoche des Deutschen Bundestages, die zugleich die letzte vor der Sommerpause ist, findet von 4. bis 8. Juli statt. Sollte das EEG 2023 nicht in dieser Woche behandelt werden, wäre nur eine Sondersitzung oder eine Verabschiedung nach der Sommerpause denkbar. Dann würde sich alles jedoch lang hinziehen, die erste offizielle Sitzungswoche nach der Sommerpause beginnt erst wieder am 5. September. Allerdings erscheint es derzeit sehr wahrscheinlich, dass der Bundestag auch in der Sommerpause Sondersitzungen durchführt, allein aufgrund der aktuellen Krisensituation bei der Gasversorgung.
Wie weit ist die EU?
Die Europäische Kommission ist mit der Prüfung der Beihilferelevanz das neue EEG schon seit Monaten beschäftigt, das wurde auch bereits vom Wirtschaftsministerium bestätigt. Der genaue Stand ist im Moment nicht bekannt, auch gibt es kein Signal, wann mit einer Freigabe zu rechnen ist. Hier scheint derzeit wahrscheinlich, dass die EU-Kommission wie beim EEG 2021 nicht eine vollständige Freigabe erteilt, sondern Teilfreigaben erlässt. Das kann die Projektumsetzung sehr kompliziert machen, denn dann wäre sehr unübersichtlich, welche Regelung des EEG 2023 nun angewendet werden darf und welche nicht. Zum EEG 2021 gibt es im Bereich der Windenergie übrigens Regelungen, die bis heute noch nicht von der EU freigegeben sind, sondern noch immer geprüft werden.
Wenn das EEG beschlossen ist, darf es doch angewendet werden, oder?
Leider nein, das kann man nicht pauschal sagen. Regelungen, die keine Relevanz hinsichtlich einer Beihilfe haben, gelten mit Verabschiedung, das heißt direkt nach Veröffentlichung des neuen EEG im Bundesgesetzblatt. Andere Regelungen, vor allem hier die Regelungen der Vergütungssätze, unterliegen dem Beihilfevorbehalt der EU-Kommission. Nach Veröffentlichung des EEG im Bundesgesetzblatt sind auch diese Regelungen bei uns zwar Gesetz, dürfen aber erst nach einer Freigabe der EU angewendet werden.
Wann kommen die neuen Vergütungssätze?
Die Bundesregierung hat im Referentenentwurf des EEG 2023 beschrieben, ab wann die neuen Vergütungssätze angewendet werden dürfen: Dort wird ein „Tag X“ genannt, an dem das Bundeswirtschaftsministerium die neuen Vergütungssätze offiziell verkündet. Das wird aus unserer Sicht kurzfristig nach Freigabe der EU dieser Vergütungssätze erfolgen. Um die neuen Vergütungssätze zu erhalten, muss ein genaues Prozedere eingehalten werden, so der Referentenentwurf: Nach Veröffentlichung der Vergütungssätze muss ein PV-Interessent seinen Netzbetreiber anschreiben und ihm mitteilen, dass er für ein neues Projekt diese neuen Vergütungssätze nutzen möchte. Erst dann darf die PV Anlage tatsächlich beim Installateur bestellt werden. Damit sollen Mitnahmeeffekte vermieden werden.
Wann kommt dieser Tag X?
Wir sind ursprünglich davon ausgegangen, dass dieser „Tag X“ im Mai oder Juni liegen wird. Doch nun ist der Juni fast vorbei, der „Tag X“ ist noch nicht in Sicht. Jetzt hängt alles von der Prüfdauer bei der EU-Kommission ab, im schlimmsten Falle könnte sich das noch Wochen oder Monate hinziehen.
Was gilt denn bis zum „Tag X“?
Bis zum „Tag X“ gilt ganz klar die Vergütungsregelung weiter, die das EEG 2021 enthält. Wenn die Freigabe noch Monate dauern würde, würden auch zu den kommenden Monatsanfängen weiter die Degression mit 1,4% pro Monat angewendet werden. Die Bundesnetzagentur hat die Sätze im bekannten 3-Monats-Zyklus ja bereits bis Juli hier kommuniziert.
Wie werden zukünftig PV-Anlagen am wirtschaftlichsten?
Zur wirtschaftlichen Optimierung ist es notwendig, die echten geltenden Vergütungssätze zu kennen, diese könnten sich im laufenden Verfahren ja noch verändern. Und auch wie sich die Anlagenpreise weiterentwickeln, wissen wir derzeit nicht. Daher würden wir derzeit vor pauschalen Antworten auf diese Frage warnen. Grundsätzlich glauben wir jedoch das es bei PV-Anlagen auf Ein- und Zweifamilienhäusern weiterhin bei Eigenversorgungsanlagen bleiben wird, vor allem unter dem Aspekt der derzeit hohen Strompreise im Haushalt.
Werden zukünftig immer zwei PV-Anlagen gebaut?
Zur wirtschaftlichen Optimierung von zukünftigen PV Projekten mit der neuen Vergütungsregelung des EEG 2023 könnte es sinnvoll sein, auf ein Dach nicht eine Großanlage, sondern zwei getrennte PV-Anlagen aufzubauen. Eine davon könnte eine Eigenversorgungsanlagen sein, die in der Größe auf den Verbrauch angepasst und optimiert wird, die zweite Anlage könnte die restliche Dachfläche als Volleinspeiseanlage belegen. Für kleine Anlagen erscheint das schon aufgrund der Zählerkosten und des hohen Aufwandes für zwei Anlagen nicht sinnvoll.
Werden nun viele große Bürgerenergie-PV-Anlagen gebaut?
Wir vermuten eher nicht. Die neue Regelung des EEG 2023 befreit Bürgerenergiegesellschaften zwar bis 6 MW Anlagengröße von der Ausschreibepflicht, formuliert hierzu aber scharfe Bedingungen, die die Bürgerenergiegesellschaft einhalten muss. Dazu gehört der lokale Bezug der Gesellschafter, Stimmrechts Verteilungsaspekte und vieles mehr. Diese Bedingungen alle zu erfüllen, wird für einige Bürgerenergiegesellschaften sicherlich nicht ganz leicht.
