Kohleausstiegsgesetz - Schlachtplan gegen die Erneuerbaren
Mit dem sogenannten Kohleausstiegsgesetz will die Bundesregierung das Energierecht an einer Reihe zentraler Stellen umkrempeln. Das geht weit über das Thema Kohle hinaus. Der Kernpunkt des Angriffs auf die Erneuerbaren Energien besteht in der Einführung pauschaler Abstandsregeln für Windräder von 1.000 Metern zu Wohnsiedlungen ab fünf Häusern. Damit wird die Flächenkulisse so sehr eingeschränkt, dass ein weiterer Ausbau der Windenergie faktisch unmöglich wird und sogar ein Rückgang an installierter Leistung droht. So wie die GroKo vor einigen Jahren bei der Photovoltaik die Zubaumöglichkeiten kurz und klein geschlagen hatte, will sie dies nun bei der Windenergie an Land durchexerzieren. Ob es im koalitionsinternen Disput um die Abstandregeln nochmals zu Veränderungen kommt, bleibt offen. Das Gesetz bezieht sich wohlgemerkt auf Wind „Onshore“. Für Windparks in der Nord- und Ostsee wird das nicht gelten. Diese sollen als Investitionsmöglichkeiten für große Konzerne und Kapitalanleger erhalten bzw. ausgebaut werden.
Dass dabei zehntausende von Arbeitsplätzen – analog zur damaligen Situation in der PV-Branche – zerstört werden, ist Altmaier und Merkel egal. Man erinnere sich an die Krokodilstränen, welche Politiker der GroKo wie auch der betroffenen Landesregierungen, allen voran der Brandenburger MP Dietmar Woidke (SPD), vergossen hatten, als es um eine weit geringere Zahl von Arbeitsplätzen in der Braunkohle ging. Die Hinterfotzigkeit der Argumentation, vor allem der Union, ist dabei kaum zu überbieten. So erklärte Joachim Pfeiffer, wirtschaftspolitischer Sprecher der CDU/CSU-Bundestagsfraktion, am Donnerstag im Berliner Inforadio, man müsse mit der neuen Windrad-Abstandsregelung die Menschen in den betroffenen Regionen schützen und könne außerdem für mehr Akzeptanz für Windkraftanlagen sorgen. Erst werden mit viel Geld Anti-Windkraftinitiativen in die Welt gesetzt und aufgepäppelt, um dann deren Argumentation als Begründung für ein Verhinderungsgesetz verwendet (siehe auch Beitrag "Windige Windkraftgegner" in dieser Ausgabe der DGS-News).
Im Kohleausstiegsgesetz steht vor allem nicht drin, dass nach der Kohle die Erneuerbaren Energien den Platz der fossilen Energieträger einnehmen müssen. Stattdessen verläuft der Fuel Switch, also der Austausch der Kohle gegen Erdgas, jenseits des Kohleausstiegsgesetzes. Aber auch der eigentliche Kohleausstieg bis 2038 wird verfehlt. Denn die Bundesregierung setzt dabei auf freiwillige Abschaltungen, für welche die Kraftwerksbetreiber Entschädigungen in Milliardenhöhe hinterhergeworfen werden. Einen gesetzlichen Abschaltplan hat sie nicht vorgesehen. Insbesondere Braunkohlekraftwerke, deren Abschaltung im Gesetzesentwurf explizit nicht vorkommt, werden damit zum Druckmittel der Betreiber im Poker um Entschädigungen. Das Gleiche gilt auch für die Dörfer, die zum Abbaggern anstehen, oder auch für den Hambacher Forst. Und noch ein wesentlicher Punkt fehlt in diesem Gesetz. Es ist nicht vorgesehen, dass für jedes abgeschaltete Kohlekraftwerk CO2-Zertifikate des Europäischen Emissionshandelssystems (ETS) im entsprechenden Umfang aus dem Handel genommen werden.
Stattdessen lässt es die Bundesregierung zu, dass mit Datteln IV ein neues, monströses Steinkohlekohlekraftwerk des Energiekonzerns Uniper (ehemals Eon) mit 1.100 MW ans Netz geht. Da ist die Aufhebung des Förderdeckels von 52 GW für Solaranlagen bis zu einer installierten Leistung von 750 kW ein schwacher Trost. Zumal sich das Gesetz auch nicht mit einem Fuel Switch in diesem Leistungsbereich, etwa bei der Wärme, befasst. Neue Gaskraftwerke, vor allem sogenannte Gasmotorenkraftwerke (also große BHKW), werden im Zusammenhang mit der Expansion der Fernwärme zugebaut, obwohl inzwischen klar ist, dass Erdgas bis zu 40 Prozent klimaschädlicher ist, als die von ihr ersetzte Kohle.
Dies Gesetz ist kein, wie mancher meinen möchte, Schildbürgerstreich, sondern ein kühl kalkuliertes Unterfangen, das nicht dem Klimaschutz dient, sondern mit dem z.B. die Investition der Konzerne, etwa von Datteln IV in Höhe von 1,5 Mrd. Euro, wieder eingespielt werden können. Vor allem die neuen großen Gaskraftwerke sollen nach dem Vorbild der Kohlekraftwerke bis ans Ende ihrer Lebensdauer profitabel am Netz bleiben können. Und die ins Haus stehenden Entschädigungen für alte Kohlekraftwerke sind eine willkommene Investitionsbeihilfe beim Einstieg in die neue Erdgaswelt. Die Argumentation mit der Brückentechnologie ist weder ernst gemeint, noch lässt sich eine vorzeitige Abschaltung oder Umrüstung großer Gaskraftwerke betriebswirtschaftlich abbilden. Neue Wege und Möglichkeiten, dass Mittelstand und Bürgerenergie in Erneuerbare Energien investieren, sind kein Thema für das Kohleausstiegsgesetz.
So gliedert sich das Kohleausstiegsgesetz in die Reihe der bereits existierenden Regelungen zur Verhinderung der angeblich angestrebten 65 Prozent Erneuerbare Energien bis 2030 ein. Das Kernproblem sind nach wie vor die Ausschreibungen, deren Mechanismen zu erheblichen Verlusten in den Branchen von PV und Wind führten. Kleine Akteure aus der Bürgerenergie können sich, nach der Eliminierung der PV-Freiflächenanlagen vor allem beim Wind das Risiko, bei Ausschreibungen leer auszugehen, nicht leisten und haben daher ihre Tätigkeiten längst eingestellt. Aber noch ein weiteres, gravierendes Problem ist im Klimapaket der GroKo ignoriert worden, nämlich die Umsetzung der Erneuerbare-Energien-Richtlinie der EU, das sogenannte „Clean Energy for all Europeans Package“.
Zum ersten Mal erhalten danach Stromverbraucher europaweit das Recht, Strom selbst zu erzeugen, zu speichern und zu verkaufen, ohne dass sie dabei mit diskriminierenden Vorgaben, unverhältnismäßigen bürokratischen Hindernissen oder Abgaben und Umlagen belastet werden dürfen. Das hatte das Europäische Parlament bereits am 13. November 2018 beschlossen und damit die EU-Mitgliedsstaaten verpflichtet, dies bis 2021 auf nationaler Ebene umzusetzen. Die Eigenversorgung aus EE-Anlagen mit einer Leistung unter 30 kW muss demnach von allen Abgaben, Umlagen und Gebühren freigestellt werden. Doch diese Umsetzung in nationales Recht hat die Bundesregierung ganz offenbar nicht in das Klimapaket aufnehmen wollen. Ob sie sich zukünftig dazu bewegen lässt, hängt vom gesellschaftlichen Druck der kommenden Monate ab. Aber die Einhaltung der Pariser Klimabeschlüsse liegt der GroKo wenig am Herzen.
