Endlagersuchverfahren: Muss der Ablauf so sein?
Nachfragen bei betroffenen Bundesorganisationen von Heinz Wraneschitz
Das unabhängige Nationale Begleitgremium (NBG) hat vom Bundestag die Aufgabe erhalten, „für ein faires Verfahren“ zu sorgen – und zwar konkret bei der bundesweiten Suche nach dem Atomendlager.
Am zweiten Juni-Wochenende hatten durchschnittlich 500 Online Anwesende bei der selbstorganisierten „2. Fachkonferenz Teilgebiete Atomendlager“ das Auswahlverfahren zur Standortsuche debattiert. Doch gerade mal fünf Tage später erklärte das NBG gegenüber der Presse: „Die Fachkonferenz und der Zwischenbericht Teilgebiete passen nicht zueinander.“ Darüber haben die DGS-News berichtet.
Direkt am Montag nach der 2. Fachkonferenz (FK) danach hatte das Nationale Begleitgremium NBG zu einem „Rückblick: Wie lief die 2. FK?“ eingeladen. An diesem Abend jedenfalls mussten sich die NBG-Mitglieder wenig Lob, sondern vor allem Kritik zur 2. FK anhören. Diese Veranstaltung dürfte also die NBG-Mitglieder beeinflusst haben, zu erklären: „FK und Zwischenbericht Teilgebiete passen nicht zueinander.“
Drei Behörden sind von dieser NBG-Einordnung besonders betroffen – und denen hat unser Autor konkrete Fragen gestellt: Welche Konsequenzen zieht Ihre Behörde aus dieser „Zentralen Beobachtung“ des NBG? Welche Folgen ergeben sich für den 3. Beratungstermin der FK Anfang August? Und: Ist der im StandAG festgelegte Zeitplan der Öffentlichkeitsbeteiligung an der Endlagersuche weiterhin aufrecht zu erhalten?
Diana Feuerer vom BASE, dem Bundesamt für die Sicherheit der nuklearen Entsorgung, antwortet nicht auf unsere Fragen, erklärt aber „Folgendes zur Einordnung“: Ihr Amt habe laut StandAG lediglich „die FK Teilgebiete einzuberufen“, jedoch „keinen inhaltlichen Prüfauftrag für den Zwischenbericht“. Dennoch werde „das BASE darauf achten, dass die BGE transparent und nachvollziehbar macht, wie sie die weiteren Ergebnisse berücksichtigen wird“.
Monika Hotopp von der BGE „stellt fest, dass der Zwischenbericht Teilgebiete genau den Zweck, den er hat, auch erfüllt“. Denn über ihn werde „im Rahmen der FK zum Teil auf einem hohen fachlichen Niveau diskutiert“. Beim 3. Termin „wird sich die BGE der Frage stellen, wie sie mit den Ergebnissen der FK Teilgebiete umgehen möchte“ und wie sie danach weiterarbeite. Aber nicht die BGE, sondern BASE sei laut StandAG für die aktuelle und weitere Öffentlichkeitsbeteiligung zuständig.
Das Bundesumweltministerium (BMU), dem sowohl BASE wie BGE zugeordnet sind, erklärt: Die im StandAG vorgesehene FK als Beteiligung der Öffentlichkeit sei „sinnvoll“ gewesen. Doch nicht das BMU, sondern „das BASE oder die Arbeitsgruppe Vorbereitung der Fachkonferenz Teilgebiete wären die geeigneten Ansprechpartner für diese Fragen“.
Die Aussagen von BGE, BASE und BMU sind nicht als der Luft gegriffen. Denn der Bundestag hat diesen Ablauf der Öffentlichkeitsbeteiligung im Standortauswahlgesetz, kurz StandAG genau festgelegt: Zuerst veröffentlicht die Bundesgesellschaft für Endlagersuche BGE GmbH den „Zwischenbericht Teilgebiete“; dann debattieren interessierte Gruppen diesen Bericht im Rahmen dreier Beratungstermine der FK; spätestens ein Jahr nach der Veröffentlichung gibt die FK eine Bewertung zum Bericht ab. Dieser Zeitraum liefe im September ab.
Doch nun die „zentrale Beobachtung aus dem 2. Beratungstermin“ des NBG: Die FK könne ihre gesetzlichen Aufgaben nur bedingt erfüllen, denn „die wissenschaftliche Arbeit der BGE zur Auswahl der zu erkundenden Standortregionen hat gerade erst begonnen“.
Carsten Träger, SPD-MdB und Mitglied im Umweltausschuss des Bundestags, sieht deshalb den Verfahrensablauf auch nicht so festgezurrt wie BASE und BGE. „Die Bürgerbeteiligung bei der Standortsuche ist ein ganz hohes Gut.“ Wenn der Beteiligungsprozess Probleme aufzeige, „dann muss er im StandAG nachjustiert werden“.
Doch das kann nicht mehr in dieser Wahlperiode passieren: der Bundestag ist nun in der Wahlkampfpause.
